Terms and Conditions

Welcome to Hinterland Hideaway Farm Stay! We are delighted to offer you a serene and memorable Farm Stay experience. Please take a moment to read our terms and conditions carefully before making a booking. By booking with us, you agree to abide by these terms and conditions.

1.1 Booking Confirmation:
Your booking is confirmed once full payment has been received. No tentative bookings are held without payment.

1.2 Payment Methods:
We accept payments via credit card, bank transfer, or other approved methods listed on our website or invoice.

1.3 Pricing:
All rates are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change until the booking is confirmed in writing.

1.4 Security Deposit:
A refundable security deposit may be required prior to check-in, along with a signed check-in form and liability waiver. The security deposit covers potential damages, additional cleaning, or breaches of these Terms and Conditions. If funds are insufficient or not reauthorised at any time during your stay (before or after check-in), we reserve the right to cancel the booking without refund.

  1. Cancellation and Refund Policy

2.1 Cancellation by Guests:

  • Invoices first issued: You have 48 hours once paid to cancel your booking and receive a full refund. After 48 hours, the following policies then apply. 
  • Cancellations made more than 14 days before the check-in date will receive a full refund.
  • Cancellations made within 14 days of the check-in date are non-refundable.
  • Long-term stays of 30 Days or More are strictly non-refundable. This is because we have to block our dates in advance, which means we would miss out on bookings we would have otherwise received. This is the only way that we can accept longer term bookings. 

2.2 Cancellation by Hinterland Hideaway Farm Stay:

In the unlikely event that we need to cancel your booking for any reason, you will receive a full refund or the option to reschedule your stay.

2.3 Early Departures:
As per our refund policy. No refunds are provided for early departures, shortened stays, or unused portions of a booking once you have checked in.

Check-in and Check-out

3.1 Check-in: Check-in is available from 3:00 PM on the day of arrival. Please notify us in advance if you expect to arrive later than 6 pm.
3.2 Check-out: Check-out is by 10:00 AM on the day of departure (unless advised in writing of another time). Late check-out may incur an additional $100 per hour fee.

  1. Guest Responsibilities

4.1 Conduct: Guests are expected to conduct themselves in a respectful and orderly manner. Any behaviour that is disruptive or damages property may result in immediate termination of the stay without a refund. Guests must behave respectfully towards staff, neighbours, animals, and property. Abusive, harrasing, threatening, intoxicated, or unlawful behaviour will result in immediate eviction without refund and may be reported to authorities.
4.2 Property Care: Guests must take care of the property and report any damages immediately. Any damages caused by guests will be charged to the credit card on file.
4.3 Maximum Occupancy: The maximum number of guests per accommodation must not be exceeded. Failure to adhere to this may result in additional charges or termination of the stay without refund.

4.4 No Re-entry or Rebooking after Termination:
Guests removed for breaches, misconduct, or unlawful activity are permanently prohibited from rebooking or entering the property. Any attempt to return will be treated as trespass and reported to police immediately.

  1. Farm Stay Rules

5.1 Noise Levels: Please keep noise levels to a minimum, especially after 9PM, to respect the area, other guests, and farm animals.
5.2 Pets: Pets are welcome only by prior written approval. Undisclosed animals will incur a $200 fee per animal or cancellation without refund. Owners must clean up after pets; droppings left in gardens may incur a $70 per hour cleaning fee.
5.3 Smoking: Smoking is prohibited inside all accommodations. Designated smoking areas are provided outside. Smoking outside of the smoking area may incur a $200 fine and an additional cleaning fee to remove the smell of smoke from the property.
5.4 BBQ & Fire Safety: No open flames, including candles and campfires, are allowed without prior permission. BBQs (including wood-fired) must be cleaned after use. Failure to do so will result in a $200 cleaning fee. Open flames or fires require prior permission and adherence to all fire bans.

5.5 Property Items:
All furnishings, décor, equipment, and accessories remain the property of Hinterland Hideaway.

Removal of any item from the property is theft and will be reported to police. The replacement cost and a $70 administrative fee will be charged to your nominated card provided at the time of check-in.

  1. Liability

6.1 Personal Belongings: Guests are responsible for their belongings. Hinterland Hideaway accepts no liability for loss, theft, or damage to personal property. A signed liability waiver must be signed before check-In: https://pci.jotform.com/form/251849468977885

6.2 Injuries: Guests acknowledge that a farm environment carries inherent risks (animals, uneven ground, natural hazards). Guests participate in activities at their own risk. Hinterland Hideaway is not liable for injury, illness, or death resulting from participation in farm or recreational activities.

6.3 Force Majeure: We are not responsible for cancellations, interruptions, or changes arising from events beyond our control, including weather, natural disasters, or government restrictions.

  1. Privacy Policy

7.1 Personal Information: We respect your privacy and are committed to protecting your personal information. Any personal information collected will be used solely to process your booking and provide services during your stay.

  1. Governing Law

8.1 These terms and conditions are governed by and construed in accordance with the laws of Gympie, Queensland, Australia. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Gympie, Queensland, Australia.

By making a booking at Hinterland Hideaway Farm Stay, you acknowledge that you have read, understood, and agree to these terms and conditions.

      9. Breach, Eviction, and Recovery

9.1 Eviction Rights:

We reserve the right to immediately terminate your stay, without refund or compensation, if you (or any member of your booking party or visitors) breach any of these Terms and Conditions, cause damage to property, engage in abusive, threatening, harassing, or unsafe behaviour towards our staff, contractors, other guests, animals, or neighbours, or create a disturbance that impacts the peace and safety of others.

This also includes — but is not limited to — making false, misleading, or deceptive statements or claims, whether verbal or written, about the property, management, staff, or contractors.

In the event of such conduct, you may be required to vacate the property immediately. We further reserve the right to request your legal representative’s details for all future correspondence and to deduct from your nominated card any costs associated with damage, cleaning, or loss arising from your breach.

9.2 Legal and Recovery Action:
We may pursue all remedies available at law or in equity, including recovery of costs, damages, or losses caused by the guest. Reasonable legal and enforcement costs may be claimed.

9.3 Trespass Enforcement:
Any unauthorised re-entry or refusal to vacate after checkout time constitutes trespass. Police will be contacted immediately.

10. Breach and Legal Correspondence

10.1 Breach of Terms:
If a guest breaches any part of these Terms and Conditions, behaves in a threatening, abusive, deceptive, defamatory, or otherwise inappropriate manner towards Hinterland Hideaway, its owners, staff, agents, neighbours, or other guests, we reserve the right to:

  • Immediately terminate the stay without refund;
  • Refuse any future bookings; and
  • Treat the conduct as a material breach of contract.

10.2 Future Correspondence through Legal Representation:
In the event of such a breach or dispute, Hinterland Hideaway may, at its sole discretion, require that all future correspondence, communications, or claims relating to the matter be conducted exclusively through the guest’s nominated legal representative.
If any terms of our terms and conditions are breached, Hinterland Hideaway may cease direct communication and refer the matter to governing authorities and its own legal representatives.

10.3 Reservation of Rights:
Hinterland Hideaway reserves all rights to seek legal advice, issue formal correspondence through its solicitors, or initiate proceedings to protect its business, property, and reputation. Any continued harassment, defamation, or unreasonable communication after such notice may be reported to law enforcement or pursued as legal harassment or defamation under applicable law.

10.4 Right to Deduct Payment:
By booking with Hinterland Hideaway, the guest authorises the property to deduct from the nominated credit or debit card any unpaid amounts arising from:

  • Damage, theft, or loss of property;
  • Excessive cleaning required due to breach of checkout or property care conditions;
  • Breach of these Terms and Conditions;
  • Fines, penalties, or costs incurred due to misconduct or violation of property rules; or
  • Any other charge reasonably incurred to restore the property or recover losses caused by the guest.
    Where the security deposit is insufficient to cover these amounts, Hinterland Hideaway may process additional charges to the guest’s nominated card without further notice.

11. Internet Connectivity, Streaming Services, and Safety Conditions

11.1 Complimentary Satellite Internet: Hinterland Hideaway Farm Stay provides complimentary internet access via satellite (Starlink) for guest use. As this is a free service, availability and performance may vary and are not guaranteed.

11.2 Weather and External Factors: Satellite internet services are influenced by weather conditions, network congestion, and third-party systems beyond our control. Connectivity may be interrupted or reduced during adverse weather or technical issues.

11.3 Equipment and Repairs: In the event of an outage or equipment fault, we will take all reasonable steps to restore connectivity as soon as possible. However, replacement parts or technician assistance may need to be sourced from Sydney or directly from Starlink, which may result in unavoidable delays.

11.4 Streaming Services: Streaming platforms and content provided during your stay (such as Netflix, Disney+, or other services) are complimentary and subject to change from month to month. Hinterland Hideaway Farm Stay reserves the right to modify or update available streaming services at any time based on our ability to provide the best available entertainment.

11.5 Safety and Access for Repairs:
If you breach any of our Terms and Conditions, or if your behaviour, actions, or the prevailing weather conditions are deemed to make it unsafe for our staff, contractors, or representatives to enter the premises, we reserve the right to delay any maintenance or repair work until it is safe to do so.
If you are asked to vacate the property due to a breach of these Terms and Conditions, or for safety reasons, all required repairs or works will be conducted once the property is vacated and safe access can be ensured.

11.6 Liability: As both the internet and streaming services are complimentary, Hinterland Hideaway Farm Stay shall not be held financially liable or responsible for any inconvenience, loss, or damages resulting from connectivity interruptions, unavailable streaming services, variations in streaming content, or any delays in repairs arising from unsafe conditions or guest conduct.

11.7 Commitment to Service Restoration: We will always act promptly and in good faith to re-establish internet and streaming services and conduct necessary repairs as soon as practicable once it is safe to do so.
